Dealing With Property During A Divorce
According to California state law, the courts are required to divide property among spouses thanks to a community property statute. Under this statute, the court divides any and all assets evenly and fairly between the spouses despite their financial statuses. Usually, this process gets started when the court begins to properly evaluate all the assets both spouses own based on their dollar value.
It is important to understand that not every asset can be divided equally among the two spouses. The only one that can be legally divided among the spouses are those that each spouse has retained their own personal property prior to their marriage. However, it is also important to understand that under the state law that any property that has been acquired during the years of one’s marriage are to be legally considered as “marital property”.
